• Digital Avatar: Digital representation created from videos provided by the User
• Voice Cloning: Artificial voice reproduction based on provided audio samples
• Credits: Unit of measurement for using Platform services

3. Acceptance of Terms

By accessing and using the Platform, the User declares to have read, understood, and fully agreed to these Terms of Use. If you do not agree with any provision, you must immediately discontinue use of the services.

4. Services Offered

Flixyu offers a video creation platform with artificial intelligence that includes:

• Digital Avatar Creation: Development of personalized digital representations
• Voice Cloning: Artificial voice reproduction for narration
• AI Video Editing: Automated audiovisual editing tools
• Professional Templates: Pre-configured models for content creation
• Video Rendering: Processing and exporting audiovisual content
• Script Generation: AI assistance for creating scripts

5. Eligibility and Registration

5.2 Accuracy of Information

The User agrees to:

• Provide true, accurate, and up-to-date information
• Keep registration data always up to date
• Not create multiple accounts for the same person
• Not transfer the account to third parties

6. Content Responsibility

6.1 User Obligations

The User declares and warrants that:

• Possesses all necessary rights over images, voices, texts, and other materials used
• Has express authorization from all individuals whose images or voices are used
• Will not violate third-party rights, including copyright, image, voice, or personality rights
• Will fully comply with all applicable laws and regulations
• Will not create content that may cause harm to Flixyu or third parties

6.2 Prohibited Content

The creation or distribution of content that:

• Violates Brazilian or international laws
• Contains defamatory, libelous, or slanderous material
• Promotes discrimination, hatred, or violence against any person or group
• Includes explicit sexual, pornographic, or inappropriate content
• Violates intellectual property rights of third parties
• Contains false or misleading information (fake news)
• Promotes illegal or harmful activities
• Represents people without authorization (unauthorized deepfakes)
• Contains viruses, malware, or malicious code

7. Legal Compliance

7.1 Consequences of Violations

In case of violation of laws or these Terms, the User:

• Will be civilly and criminally liable for their actions
• Will fully indemnify Flixyu for damages caused
• Will have their account suspended or terminated immediately
• Will lose the right to refunds or credits

8. Credits System and Payments

8.1 How Credits Work

• Services are charged in credits according to usage
• Video creation: charged per minute (rounded up)
• Avatar creation: fixed charge per avatar created
• Unused credits do not expire while the account is active

8.2 Plans and Subscriptions

• We offer monthly plans with included credits
• Payments processed via Stripe with security
• Automatic renewal, which can be canceled at any time
• Subscription management through the customer portal

8.3 Refund Policy

8.3.1 Refund Cases

Refunds will be granted exclusively in the following cases:

• Proven technical failure of the Platform that prevents completion of processing
• Total service unavailability for more than 72 consecutive hours
• Systemic error resulting in irreversible corruption of processed data
• Improper charge for credits not actually used

8.3.2 Express Exclusions

The following do not constitute grounds for refund:

• Dissatisfaction with quality, aesthetics, or characteristics of generated content
• Unmet expectations regarding the final result
• Incompatibility between the result and the User's personal preferences
• Technical limitations arising from the quality of provided material
• Subscription cancellation does not generate right to proportional refund
• Change of mind after processing has started
• Improper use of the Platform by the User

8.3.3 Request Procedure

• Disputes must be reported within 30 calendar days of occurrence
• Technical proof of the alleged failure is mandatory
• Careful analysis will be conducted by Flixyu's technical team
• Final decision rests exclusively with Flixyu and is not subject to appeal

9. Intellectual Property

9.1 User Content

• The User retains all rights to content created
• Flixyu does not claim ownership of videos, avatars, or voices created
• The User grants Flixyu a limited license to process and store content

9.2 Flixyu's Property

• The technology, algorithms, and software are Flixyu's exclusive property
• Templates and resources provided by the Platform are licensed for use
• Reverse engineering or attempts to reproduce the technology are prohibited

10. Usage Limitations

10.1 Proper Use

The User agrees to:

• Use the Platform only for legitimate purposes
• Not overload systems with excessive use
• Not attempt to circumvent technical or credit limitations
• Not interfere with Platform operations

10.2 Technical Limitations

• Videos for avatars: maximum 20 seconds and 100MB
• Audio for voices: maximum 50MB
• Processing: subject to server capacity
• Storage: according to contracted plan

11. Suspension and Termination

11.1 Suspension by Flixyu

Flixyu may suspend or terminate accounts in case of:

• Violation of these Terms of Use
• Suspicious or fraudulent activity
• Non-payment of amounts due
• Improper use of the Platform
• Court order or competent authority determination

11.2 Termination by User

• The User may terminate their account at any time
• Data will be deleted according to the Privacy Policy
• Unused credits will be forfeited
• Active subscriptions must be canceled separately

12. Limitation of Liability

12.1 Service Availability

• The Platform is offered “as is” and “as available”
• We do not guarantee uninterrupted or error-free operation
• Scheduled maintenance will be communicated in advance
• Technical failures will be corrected as soon as possible

14. Modifications to Terms

• Flixyu reserves the right to modify these Terms at any time
• Significant changes will be communicated by email or on the Platform
• Continued use after changes constitutes acceptance
• Users who do not agree should discontinue use of the Platform

15. Privacy and Data Protection

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms. The User declares to have read and agreed to all data collection, use, and protection practices described therein.

16. Dispute Resolution

16.1 Attempt at Agreement

Any disputes should first be communicated via email to dpo@flixyu.com, seeking amicable resolution.

16.2 Competent Jurisdiction

To resolve any disputes arising from these Terms, the jurisdiction of Salvador/BA, Brazil is elected, with express waiver of any other, however privileged it may be.

17. Applicable Law

These Terms of Use are governed by Brazilian laws, particularly the General Data Protection Law (LGPD), Brazilian Internet Civil Framework, Consumer Protection Code, and other applicable regulations.

• These Terms constitute the entire agreement between the parties
• The invalidity of any clause does not affect the validity of the others
• Failure to exercise rights does not constitute waiver
• These Terms bind heirs and successors
